Welcome to Tip Top Photo Booth LLC. These Terms and Conditions govern your use of our photo booth services. By booking our services, you agree to comply with the terms outlined below. If you do not agree, please refrain from using our services.
Definitions

"We," "Us," and "Our" refer to Tip Top Photo Booth LLC, operating in Silicon Valley, California.

"You" and "Client" refer to the individual or business booking and using our services.

"Services" refer to the photo booth rental services offered by Tip Top Photo Booth LLC.
Service Availability
Our photo booth services are available based on equipment and staff availability. Services are confirmed upon booking, subject to date and package availability. We reserve the right to refuse service for reasons such as a violation of these terms or lack of availability.
Booking and Payment
A booking is confirmed only after a signed contract and a non-refundable 50% deposit of the total service fee have been received. The remaining balance must be paid no later than 3 days before the event. Failure to complete payment may result in cancellation without a refund of the deposit. We accept payments via credit card, debit card, PayPal, or other methods specified at booking.
Cancellations and Refunds

Client-Initiated Cancellations:

Cancellations made 7 days or more before the event are eligible for a partial refund, excluding the 50% deposit.

Cancellations made within 7 days of the event are non-refundable.

If the Client cancels 24 hours or less before the scheduled start time, all payments made to Tip Top Photo Booth LLC are non-refundable. The Client acknowledges that last-minute cancellations result in lost business opportunities and incurred expenses for Tip Top Photo Booth LLC.

Company-Initiated Cancellations:

If Tip Top Photo Booth LLC cancels due to unforeseen circumstances, you will receive a full refund or the option to reschedule at no additional cost.
Rescheduling Policy
Clients may reschedule an event once without charge if the request is made at least 7 days before the scheduled event. Additional rescheduling requests may incur a fee and are subject to availability.
No-Show Policy
If the Client fails to provide access to the venue or is otherwise unavailable at the agreed-upon start time, this will be considered a cancellation, and no refunds or credits will be issued.
Event Requirements
Clients must ensure the event space can accommodate the photo booth and equipment. We require a minimum space of 10' x 10' with access to a standard power outlet.
For outdoor events, Clients must provide adequate coverage (e.g., tent, canopy) to protect equipment from weather. If sufficient protection is not provided, we reserve the right to refuse setup.
Clients must inform us of any venue restrictions (e.g., noise, lighting, power) in advance. Failure to do so may result in service limitations or cancellation without refund.
Liability
While we strive for smooth operations, we are not liable for delays due to traffic, venue issues, or other factors outside our control. Clients are responsible for damages to equipment caused by guest negligence and may be liable for repair or replacement costs. We are not responsible for data loss due to technical failures.
Image and Video Use
By booking our services, you and your guests agree that Tip Top Photo Booth LLC may use photos and videos from the event for marketing purposes, including social media and our website, unless the Client submits a written requestopting out before the event.
User Conduct
Clients agree to use our services lawfully, avoid causing damage to equipment, and respect staff and their instructions during the event.
Intellectual Property
All content, including the photo booth design, software, and event materials, is the intellectual property of Tip Top Photo Booth LLC. You may not use or reproduce any content for commercial purposes without written permission.
Force Majeure
Tip Top Photo Booth LLC is not liable for delays or cancellations due to events beyond our control, including natural disasters, extreme weather, acts of government, or other unforeseeable events. In such cases, we will work with you to reschedule as soon as possible.
Indemnification
You agree to indemnify and hold harmless Tip Top Photo Booth LLC from any claims, damages, or legal proceedings arising from your use of our services, including injuries or damage caused by guests or third parties.
Governing Law
These Terms and Conditions are governed by the laws of the State of California. Any disputes will be resolved in the courts of Santa Clara County, California.
